Terms of Service

Effective April 17, 2026 | Bermingham Media LLC d/b/a Rebuilt Web Studio

1. Services

Rebuilt Web Studio provides website design, hosting, maintenance, and support services for small businesses. Services include custom website design, hosting on Cloudflare, SSL certificates, ongoing maintenance and content updates, SEO optimization, and client support via chat, text, and email.

2. Pricing and Payment

• Setup Fee: $250 one-time, due at project kickoff
• Monthly Fee: $50/month, billed automatically via credit/debit card
• Payment Processor: Stripe (PCI compliant)
• Billing Cycle: Monthly, starting on the date of first payment
• Failed Payments: If a payment fails, we will attempt to charge the card 3 times over 7 days. If all attempts fail, the site may be temporarily suspended until payment is resolved.

3. What You Get

Included in your monthly subscription: hosting, SSL, CDN, daily backups, unlimited reasonable text and photo updates (same business day turnaround), contact form management, SEO monitoring, Emily support concierge, and monthly analytics summary.

Unlimited revisions before your site goes live. After launch: 5 revisions per week.

4. Domain Ownership

Your domain name belongs to you. We do not register domains in our name without your written consent. If you cancel, you keep your domain. We will assist with DNS transfer back to your control at no charge.

5. Content Ownership

• Your Content: You own all text, photos, logos, and other content you provide to us.
• Our Work: The website design, code, and structure is our work product. Upon full payment, we grant you a perpetual, non-exclusive license to use the design.
• Upon Cancellation: We provide an export of your website files at no charge.

6. Cancellation

• Cancel at any time with no penalty or cancellation fee
• Cancellation takes effect at the end of your current billing cycle
• No refunds for partial months. Setup fee is non-refundable once work has begun.
• We export your site files upon request
• Your site remains live for 30 days after cancellation to allow migration

7. Acceptable Use

You agree not to use our services to host illegal content, distribute malware or spam, violate intellectual property rights, or attempt to access other clients' data. We reserve the right to suspend or terminate service for violations.

8. Uptime and Liability

We target 99.9% uptime using Cloudflare infrastructure. We are not liable for downtime caused by Cloudflare outages, DNS propagation, registrar issues, or force majeure. Our total liability is limited to fees paid in the 3 months preceding the claim. We do not guarantee specific search rankings or traffic.

9. Data and Privacy

We handle your data per our Privacy Policy. We do not sell personal information. Contact form submissions are delivered to you and stored temporarily for backup. Cloudflare and Stripe privacy policies apply to their respective services.

10. Changes

We may update these terms with 30 days notice via email. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Oregon. Disputes will be resolved in the courts of Josephine County, Oregon.
